Air Crash at Toronto Pearson International Airport on February 17, 2025, MDL No. 3155
This multidistrict litigation consolidates for pretrial purposes all federal cases asserting personal injury and property damage claims arising from the crash landing of Delta Flight 4819 at Toronto Pearson International Airport on February 17, 2025.
The defendants in this litigation are Delta Air Lines, Inc., and Endeavor Air, Inc.
In the federal court system, when multiple cases are pending in several different district courts that involve common questions of fact, the law provides that the Judicial Panel on Multi District Litigation (“JPML”) can transfer all of the federal cases to one federal judge, if centralization will serve the convenience of the parties and the witnesses and promote the just and efficient conduct of the litigation for pretrial purposes.
On August 8, 2025, the JPML determined that these lawsuits “share factual questions” and assert “claims against the same two defendants under the Montreal Convention, a treaty that governs international travel and limits liability for air carriers.” The JPML also found that “[c]entralization will eliminate duplicative discovery, particularly with respect to potential international discovery; prevent inconsistent pretrial rulings; and conserve the resources of the parties, their counsel, and the judiciary."
The JPML selected the District of Minnesota as the appropriate forum because “the accident flight departed from Minneapolis, the flight crew is based there, and Endeavor Air, which operated the flight, is headquartered in Minnesota.”
