Life Time Fitness, Inc. - MDL 14-2564

Telephone Consumer Protection Act (TCPA) Litigation

Introduction

In Re: Life Time Fitness, Inc., Telephone Consumer Protection Act (TCPA) Litigation,
No. 14-md-2564 (JNE/SER).

In the spring and summer of 2014, several putative class actions were filed in federal district courts in Illinois, Minnesota, and Missouri alleging that Life Time Fitness, Inc. had violated the Telephone Consumer Protect Act, 47 U.S.C. § 227 et seq., by sending unsolicited commercial text messages using an automatic dialing system without the recipients' consent.

In October of 2014, the Judicial Panel on Multidistrict Litigation determined that efficiencies could be gained by centralizing these cases, and any other similar case subsequently filed in federal court, for coordinated pretrial proceedings in a single district. The JPML selected the District of Minnesota as the most appropriate transferee district and assigned the litigation to the Honorable Joan N. Ericksen.

In November of 2014, the Court approved the following leadership structure for the Plaintiffs in the pretrial proceedings:

  Lead Counsel:

  • Shawn J. Wanta, Esq.
  • Baillon Thome Jozwiak & Wanta LLP
  • 222 South 9th Street, Suite 2955
  • Minneapolis, MN 55402
  • (612) 252-350

  Executive Committee:

  • J. Gordon Rudd, Jr., Esq.
  • Zimmerman Reed, PLLP
  • 1100 IDS Center
  • 80 South 8th Street
  • Minneapolis, MN 55402
  • (612) 341-0400

  • David T. Butsch, Esq.
  • Butsch Roberts & Associates LLC
  • 231 South Bemiston Avenue, Suite 260
  • Clayton, MO 63105
  • (314) 863-5700

  • Katrina Carroll, Esq.
  • Lite DePalma Greenberg, LLC
  • 211 West Wacker Drive, Suite 500
  • Chicago, IL 60606
  • (312) 750-1265

The Plaintiffs subsequently filed a Consolidated Class Action Complaint for the purposes of the pretrial proceedings.
